How a Default Judgment Secured $250,000 for Injured Worker

Jessica Moots found herself in a challenging situation when she suffered a serious finger injury at her workplace. She was initially planning to seek compensation through the workers' compensation system, but we learned that her employer did not carry the workers’ compensation insurance coverage that is required in Missouri, so we filed a civil action in court to continue her workers' compensation claim under statutory exception.

However, despite being given the opportunity to respond within the time limits, the employer remained silent. Because of this, we were able to file a default judgment against her employer. A default judgment can be filed when a party fails to answer or otherwise defend a lawsuit. A motion for default judgment lets the court know that the other party has failed to answer and asks them to find in our favor due to that failure. 

The judge granted our motion for default judgment and after having a hearing on the suffering and injuries Ms. Moots incurred as a result of her workplace injury, the judge entered a judgment against her employer in the amount of $250,000. 

Now that we have this judgment we are able to use Missouri's rules on garnishment and foreclosure to collect on the judgment and get Ms. Moots the compensation she deserves.
